Terms of Service

These Terms of Service ("Terms") govern your access to and use of H5Tennis, an online platform for scheduling, scoring, and following tennis matches operated by H5 Enterprises, LLC ("H5Tennis," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account. If you are between 13 and 17, you represent that a parent or legal guardian has reviewed these Terms and consents to your use of the Service. If you are under 13, you may not create an account; a parent or guardian may create and manage an account on your behalf.

2. Accounts and Roles

Accounts are created with one or more roles (Player, Scorekeeper, Coach, Tournament Director, Administrator). Different roles have different permissions; for example, only Tournament Directors can manage tournaments, and Coaches manage their school's dual meets. You are responsible for keeping your credentials confidential and for all activity on your account.

3. Acceptable Use

You agree not to:

• Submit false match results, impersonate another user, or manipulate ratings or rankings.
• Use the Service to harass, threaten, defame, or harm any person.
• Attempt to gain unauthorized access to any account or to the Service's infrastructure.
• Reverse engineer, scrape, or copy the Service, except as expressly permitted.
• Use the Service in violation of applicable law or third-party rights.
• Send unsolicited messages or use spectator share links to broadcast spam.

4. User Content

You retain ownership of content you submit (player profiles, photos, notes). By submitting content, you grant H5Tennis a non-exclusive, worldwide, royalty-free license to host, display, and process that content as needed to operate the Service. Tournament-context match results and rankings remain part of the historical record even if your account is deleted.

5. Intellectual Property

The Service, including its design, features, software, and trademarks, is owned by H5 Enterprises, LLC and its licensors. We grant you a limited, non-transferable license to use the Service in accordance with these Terms. All other rights are reserved.

6. Messaging

If you opt in to SMS or WhatsApp messages, you consent to receive automated messages at the phone number you provided, in accordance with our Messaging Policy and Privacy Policy. Standard message and data rates from your carrier may apply.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT MATCH RESULTS, RATINGS, OR NOTIFICATIONS WILL BE TIMELY OR ACCURATE, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, H5 ENTERPRISES, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless H5 Enterprises, LLC and its affiliates, officers, and employees from any claim, demand, loss, or damages arising out of your breach of these Terms, your misuse of the Service, or your violation of any third-party right.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms or use the Service in a way that creates risk or legal exposure for us or other users. On termination, the provisions that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You and H5Tennis agree that any dispute will be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms here with a new "Last updated" date and, for material changes, may notify you via email or in-product banner. Continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.
